Warner Music Group is making its music available for US downloads from Amazon in MP3 format without copy protection. Warner had been holding out against using the format because MP3 tracks are easier to share between users and may be freely burned onto CDs. Amazon.com’s download store is a major US competitor to Apple’s iTunes, which uses Digital Rights Management (DRM) to restrict the use of some of its tracks. Warner’s artists include Led Zeppelin, Aretha Franklin and Sean Paul. Sony BMG is now the only major recording group not signed up with Amazon.com’s download service, which is only available to US customers at present. “By removing a barrier to the sale and enjoyment of audio downloads, we bring an energy-sapping debate to a close,” Warner Music chief executive Edgar Bronfman said in an e-mail to Warner employees. Amazon launched its US download store in September after reaching agreements to sell unprotected tracks from Universal Music Group and EMI.

Google cofounder Sergey Brin told public radio’s Marketplace that around one percent of all Google searches go through the “I’m Feeling Lucky” button. Because the button takes users directly to the top search result, Google doesn’t get to show search ads on one percent of all its searches. That costs the company around $110 million in annual revenue, according to Rapt’s Tom Chavez. So why does Google keep such a costly button around?”It’s possible to become too dry, too corporate, too much about making money. I think what’s delightful about ‘I’m Feeling Lucky’ is that it reminds you there are real people here,” Google exec Marissa Mayer explained, or at least tried to.

‘Your move freeloaders, eh?’

Popular BitTorrent site Demonoid.com has been taken offline after legal threats to its webhost by the Canadian Recording Industry Association (CRIA).

A message on the Demonoid front page reads: “The CRIA threatened the company renting the servers to us, and because of this it is not possible to keep the site online. Sorry for the inconvenience and thanks for your understanding.”

According to Demonoid’s IRC channel, the BitTorrent trackers themselves have not been affected by the latest legal sabre rattling, and it’s thought the site will return.

Six weeks ago Demonoid was forced to close because of CRIA legal pressure. The site and trackers returned, but with a block on users from Canada.

Clearly, the CRIA doesn’t pay any heed to a report commissioned by the Canadian government that said P2P is having no negative effect on CD sales.

In a speech in February, CRIA boss Graham Henderson bemoaned Canada’s “culture of piracy”.

The shuttering of Demonoid, however temporary, marks a further escalation of recent international record industry moves against file sharers. OiNK was raided in October in the UK, eDonkey servers in Germany were seized in September, and the RIAA scored a huge legal victory when Minnesota woman Jammie Thomas was fined $220,000. ®

EMI goes after Sideload

MP3.com founder Michael Robertson is on the receiving end of another lawsuit – from EMI – this time against his MP3tunes.com and Sideload.com services.

Robertson told Reuters it was retaliation for a suit his Sideload.com service had filed against EMI in September.

MP3Tunes is a service that enables the user to back up their music collection and access it anywhere. Multiple concurrent access is prohibited – so it’s hard to imagine how it could be construed as infringing copyright. In fact, it’s just the sort of service recording sound owners should be offering as a value-add to physical offerings.

The legality of Sideload.com is more dubious. This additional service the music stored in MP3Tunes’ “lockers” and allows subscribers to grab a copy and drop them into their own locker. Sideload ducks the copyright issue.

“It’s possible some of the tracks may be unauthorised,” Robertson told a local paper when the service launched. “But the difference between Sideload and [the original] Napster is that we’re simply a search engine; we’re no different than Google.”

As with any technology, what’s “illegal” today could simply be viewed as “not licensed… yet”.

It’s seven years since Robertson’s MP3.com paid over $200m in damages for operating a similar service. A judge ruled that MyMP3.com breached mechanical copyright by allowing users to upload legitimately-acquired CDs and stream them over the internet. Robertson later sold MP3.com to Universal Music for over $370m.

But with almost half of all BitTorrent transfers now encrypted, and impossible to track – you might think the music business would see services such as Sideload.com as a revenue opportunity.

After all, you can’t count something you can’t see. ®

Amazon’s Kindle e-book reader has sold out despite scepticism about whether the device will prove popular. A notice on the Kindle pages on the Amazon web store said “heavy customer demand” for the device meant it would be out of stock until 3 December.

Since its launch on 19 November the device has been widely examined but opinions about it are mixed.

It has won praise for being easy to use but many have criticised the way it forces people to pay for free content.

Reader reviews

The Kindle device was on sale on the retailer’s store soon after Amazon boss Jeff Bezos unveiled it earlier this week. Within hours, reported gadget blog Engadget, the device had sold out prompting Amazon to add a message about stocks being replenished early next month.

Despite this sales success reviews of Kindle on the Amazon site are divided. Overall the gadget has won a rating of 2.5 stars out of five from those who have spent time with it.

Many Amazon reviewers praised its easy to read screen and the size and heft of the device. Owners of it also like the inbuilt Amazon store and the ease with which they can load books and other documents on to it via the EVDO network of US carrier Sprint.

Amazon has remained tight-lipped on whether the gadget will be available outside North America.

But Kindle has won negative press from many other reviewers who were sharply critical of its price, the rights protection technology it used and the surcharges it adds if owners load their own documents on to it.

Joel Johnson, writing for BoingBoing, said the $400 (£194) price tag was simply too high. He also criticised the cost of getting at blogs ($2 per month) newspapers ($15 per month) that can be had for free via the web.

Mr Johnson also wondered why Kindle did not support the widely popular PDF format.

Peter Ha writing for the gadget section of Tech Crunch was impressed by Kindle when he started using it but wondered whether it justified its high price.

Writing on his blog, Nicholas Carr, said the price and copy protections on content downloaded from Amazon were “deal-breakers” and declared that it had a “huge mountain to climb”.

Kindle also has some established competition in the form of the Sony PRS 505 Reader, Bookeen Cybook V3 and the iRex Iliad. However, neither gadget has so far won significant success.
